A threat to organic farmers anywhere is a threat to organic farmers everywhere! It's time to stand up!

Already Steve Marsh’s landmark case to protect himself and his farm from contamination by Monsanto’s patented GMO crops has finished its second week of trial and people around the world are watching if the court will choose to protect farmers’ livelihoods and our right to eat food free from GMO contamination.

Marsh’s case is one of pioneering civil negligence designed to recover damages and loss of income due to the contamination of 70% his organic fields by his neighbor’s genetically engineered canola, which resulted in Marsh losing his organic certification and tens of thousands of dollars of earnings.

This is the first time in Australia that a farmer has sued another farmer for negligence due to GMO contamination and it will set a precedent for future cases in Australia and beyond.

As it stands now the risk of genetic contamination is placed on the organic and non-GMO farmer. Because of the way that Monsanto writes their contracts, Monsanto is not liable when organic farmers' fields are contaminated.

As a result, the only way that Steve Marsh could recover significant economic damages is to sue his long-time neighbor and childhood friend, who planted and signed a licensing agreement for Monsanto’s patented genetically engineered canola. Due to the "no liability" fine print in these contracts, Monsanto cannot be held liable, hence hanging their customers (farmers) responsible for an event such as this.

The labeling system in Australia and New Zealand is full of loopholes and often the only way to be certain that a food is GMO-free is to buy organic. When Steve took his issue to the Agricultural Minister at the time, Terry Redman, he was told that the organic standards are to blame for his loss, suggesting that organic foods should allow contamination by GMO. We disagree and believe that it is a fundamental right of all of us to grow and eat GMO-free foods, especially organic foods.
